Here\u2019s the difference explained.<\/p>\n\n\n\n<div class=\"wp-block-eures-plugin-accordion-block\"><div class=\"accordion-top\"><p class=\"accordion-title\">What is a detached worker?<\/p><svg viewBox=\"0 0 24 24\" stroke-width=\"1.5\" fill=\"none\" xmlns=\"http:\/\/www.w3.org\/2000\/svg\" class=\"accordion-top__icon\"><path d=\"M3 12L21 12M21 12L12.5 3.5M21 12L12.5 20.5\" stroke-width=\"1.5\" stroke-linecap=\"round\" stroke-linejoin=\"round\"><\/path><\/svg><\/div><div class=\"accordion-content\">\n<p>Secondment involves the temporary assignment by an employer of an employee:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>to a place of work different from that specified in the contract;<\/li>\n\n\n\n<li>for a limited period;<\/li>\n\n\n\n<li>while maintaining a subordinate relationship with the company that is seconding the employee.<\/li>\n<\/ul>\n\n\n\n<p>Seconding an employee abroad has consequences in three specific areas:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Social security:<\/strong> In which country will the employee be affiliated for social security purposes, and what procedures must the employer follow?<\/li>\n\n\n\n<li><strong>Labor law:<\/strong> Which labor regulations will apply to the employee during the period of the assignment abroad?<\/li>\n\n\n\n<li><strong>Taxation:<\/strong> In which country will the employee be liable for taxes?<\/li>\n<\/ul>\n\n\n\n<p>Note that the concept of \u201csecondment\u201d in these three areas is independent of each other.<\/p>\n\n\n\n<p>An employee may be considered seconded from a social security perspective but not necessarily from a tax perspective.<\/p>\n\n\n\n<p>For example, consider a cross-border worker who resides in France, works in Luxembourg, and is seconded to Germany for 7 months:<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><th><\/th><th>Labor law<\/th><th>Social security<\/th><th>Taxation<\/th><\/tr><\/thead><tbody><tr><td>Cross-border worker<\/td><td>Luxembourg<\/td><td>Luxembourg<\/td><td>Luxembourg<\/td><\/tr><tr><td>Seconded worker<\/td><td>Luxembourg + mandatory German rules for the period of secondment<\/td><td>Luxembourg<\/td><td>Germany<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p>Note: Certain conditions and thresholds may apply.
